Is PTI eligible for reserved seats in the National Assembly: Can Imran Khan’s party become the largest parliamentary force?
After the decision of the Supreme Court regarding specific seats, it has become important whether Imran Khan’s Tehreek-e-Insaf will now become the party with the most seats in the National Assembly.
It should be noted that on Friday, a 13-member bench headed by Chief Justice Qazi Faiz Isa accepted the appeal of the Sunni Ittehad Council regarding specific seats by a majority vote. Tehreek-e-Insaf has directly benefited from this decision.
The appeal filed by the Sunni Ittehad Council against the Peshawar High Court’s decision was approved by eight judges while five judges disagreed with the majority decision.
The Supreme Court has said in its decision that the selected candidates of Pakistan Tehreek-e-Insaaf cannot be declared as members of any other party and only PTI is entitled to get specific seats. Thus now Tehreek-e-Insaaf has become a political party and has become an opposition party and such an opposition which can have more seats than any other party.
Justice Mansoor Ali Shah in his decision said that after independent candidates join the political party, considering its number, keeping the principle of proportional representation in front, specific seats should be given to this party i.e. PTI.
Justice Mansoor Ali Shah said that if any member has any misunderstanding, he can approach the court again.
Justice Mansoor Ali Shah while delivering the verdict said that the decision of the Election Commission in March regarding the specific seats is unconstitutional and the decision of the Election Commission which was upheld by the Peshawar High Court is also nullified.
Justice Mansoor Ali Shah while pronouncing the verdict said that PTI is entitled to take reserved seats for women and minorities and also reserved seats should be given to PTI in Punjab, Khyber Pakhtunkhwa, and Sindh.
The Supreme Court has said in its decision that PTI as a party has the legal and constitutional right to get certain seats. They will be considered as members of this party.
Justice Mansoor Ali Shah while delivering the verdict said that the Sunni Ittehad Council cannot take reserved seats as per the constitution while PTI as a political party complies with the law and the constitution.
Justice Mansoor Ali Shah while narrating the ‘operative part’ of the decision said that during the hearing of this appeal, the Election Commission submitted the data of 80 candidates.
He said that the right of a party to participate in the election does not end due to the loss of election symbols.
